A man charged with stealing from Kirsten Dunst has told police he had permission to be there because he was with the drug dealer invited to the actress's hotel room.

James Jimenez is accused of stealing a Balenciaga handbag containing around $2000 in cash from Dunst as well British actor Simon Pegg’s iPod and camera which were left in a New York hotel penthouse in 2007, the NY Post reported.

But Jimenez's lawyer said his defendant was simply tagging along to the hotel with friend Jarrod Bienerman, who he described as " a major New York drug dealer".

Mr Parker told the court that Jimenez and Bienerman would have had to run a gauntlet of security guards to access the penthouse, which was being used as a greenroom for Pegg and Dunst during the shoot.

"There is a very good explanation as to why my client was there," defence lawyer Robert Parker told the jury.

"There were drugs in the room of Kirsten Dunst and Simon Pegg."

Dunst and Pegg were filming the movie How To Lose Friends and Alienate People at the time of the robbery.

Bienerman is currently serving a prison sentence for the robbery and on a heroin dealing charge.

Jimenez avoided a sentence in a mistrial last year after his lawyer argued that he was too dumb to realise Bienerman was robbing the actors' hotel rooms.

Dunst is expected to testify next week.
