A Perth man says he was never given the option of pressing charges against the police who tasered him 13 times.

Kevin Spratt, 41, was repeatedly tasered by two prison guards as other guards watched at the East Perth lock-up in August 2008.

The incident, which followed Mr Spratt's arrest for assaulting two police officers, was captured on security vision.

The two officers escaped with fines of $750 and $1200 respectively because, police say, Mr Spratt chose not to press charges.

But the Aboriginal man said he never told police he did not want to press charges — and claims he only decided not to pursue the officers who tasered him because he believed that if he did so he would not get parole.

"I was in prison, I was terrified of the police and I didn't want to go against anything that they said because I would be seen as a troublemaker," Mr Spratt told ABC News.

"I have been tortured in police custody and the police are trying to put a further injustice upon me by blaming me for the failure to prosecute the officers."

Mr Spratt said the two officers seen tasering him in footage, released by Western Australia's Corruption and Crime Commission, should face 13 counts of assault occasioning bodily harm.
